San Diego Train Accident Kills Pedestrian

Roger Lee Bailey, 46, while trying to cross the train tracks in the North San Diego County city of Oceanside, was struck and killed by an Amtrak train on September 18, 2010 around 11:55 p.m. Oceanside Police Sgt. Travis Norton said that the man was trying to cross the tracks on the 200 block of Surfrider Way when he tripped and was struck by San Diego bound train.

The train stopped at the accident scene to await investigating officers from San Diego County Sherriff’s Department. The exact reason of Bailey’s presence on the tracks is not clear, although it appears that he was trying to cross the railroad track and may have been trying to “beat” the train. It is also not clear whether Bailey was under the influence of drugs or alcohol or sober when this fatal train accident occurred.

The exact cause of this injury accident still remains under investigation. If it is found that the train driver’s negligence or inattentiveness caused this fatal train accident, then he and Amtrak might be held responsible for the victim’s death and may be civilly liable to pay the cost of his funeral, loss of earnings, and loss of love and companionship. More facts are needed to determine if this is the case.

Oceanside Motorcycle Accident Caused by Hit-and-Run SUV Driver

An Oceanside motorcycle crash on Highway 76 near the Interstate 5 onramp on June 28 was reportedly caused by a hit-and-run SUV driver who had fled the scene, along with his two passengers.

The accident occurred around 7 p.m. on Sunday when the driver of a GMC Yukon ran a red light on westbound 76 as they drove toward the onramp, which then caused the motorcycle coming towards them to broadside the SUV. The passenger on the motorcycle was a 20-year-old Escondido woman who was ejected and crashed through one of the Yukon’s windows and ultimately landing inside of the SUV. The driver of the motorcycle, known only as a man from Escondido, crashed into the SUV and landed on the road. Both riders from the motorcycle had to be flown to a San Diego trauma center with non-life threatening injuries

San Diego Police Department Officer Acquitted for Oceanside Car Accident and Road Rage Assault

The case involving off-duty San Diego Police Officer Frank White has finally been settled. On Monday, a jury found Officer White not guilty in this road-rage car accident that occurred in Oceanside in March of 2008 that culminated in the shooting of a woman and her young son. Officer White, 29, was acquitted of a felony count of grossly negligent discharge of a firearm and a misdemeanor count of exhibiting a firearm.

Prosecutors of the case argued that White was an easily-angered man who had no justification for not only displaying his revolver, but also firing five rounds into Rachel Silva’s car at night on March 15, 2008. Silva had been struck twice in the arm and her son was struck in the leg. Deputy District Attorney Jeff Dusek noted that as a trained police officer, White should have taken other steps to diffuse the situation that brought about the shootings. White had been off-duty and not in uniform at the time it happened, and his wife Jacquellyn was reportedly with him at the time.

Victim of Fatal Oceanside Auto Accident Identified

Finally, after much investigation, the identity of a man who died from an car crash in Oceanside was revealed by authorities yesterday as Richard W. Elmore. 95 years old and a widow, the San Diego County medical examiner said that Elmore was found unresponsive in his car on Friday, January 22, along the 1900 block of Henie Hills Drive in Oceanside. He was declared dead at 6:16 p.m. shortly after he was brought to the Tri-City Hospital’s emergency room by paramedics. He was given advanced cardiac life support while on the way to the hospital.

According to authorities, Elmore’s car accident and subsequent death was accidental in nature and involved serious trauma to his spine as a result of the force of the collision. Despite this, it is unknown when the car crash happened and Oceanside police are investigating the case.
