What are the Deadlines for Filing Social Security Disability?

Social Security Disability Insurance (SSDI) provides benefits for those who suffer marked or serious disabilities that are likely to last at least one year and/or result in death. But when applying for SSDI benefits, it’s important to be aware of time limits and deadlines.

The letters and paperwork you receive from the Social Security Administration (SSA) will contain specific deadline dates for filings, requesting reconsideration of a denial, and other actions. However, here are a few initial time limits of which you should be aware.

First, the passing of time might affect whether you qualify for benefits. For most adults, in order to qualify for SSDI benefits, you must have acquired at least 40 “work credits,” measured by your earnings from work. Up to four credits may be earned each year. At least 20 of these credits must have been earned within the past 10 years, so the longer you wait to file for SSDI benefits, the more likely it becomes that your work history will not fall within the 10-year requirement.

Next, if you are turned down for benefits after your initial application, you have the right to ask for a “reconsideration” of your case by the SSA. You have 60 days from the date you receive your denial letter to request reconsideration.

Los Angeles Boy Killed As He Crosses Street

A Southern California boy was killed last week when he was crossing a street in Los Angeles. The 14-year-old boy from Inglewood named Semaj Spencer was the tragic victim of this hit and run pedestrian accident. The suspect of the death has been charged with misdemeanor vehicular manslaughter and a felony count of leaving the scene of an accident.

Prosecutors in the case note that 40-year-old Andre Thompson of South Los Angeles had also been charged on Thursday with driving under a suspended or revoked license, which is considered a misdemeanor in California. Thompson has pleaded not guilty to his charges in an Inglewood Superior Court, however. He also reportedly turned himself into the police earlier this week and was subsequently arrested in the death of young Semaj Spencer. The teen boy was struck by the vehicle and killed last Sunday when he crossed the road at Imperial Highway in Los Angeles.

Costa Mesa Pedestrian Collision Seriously Injured By Drunk Driver

21-year-old Katushka Fischmann of Santa Ana was struck and injured in a serious DUI crash that occurred on August 7, 2011, around 1:45 a.m. at the intersection of Bristol Street and Randolph Avenue in Costa Mesa.

Santa Police reported that Bonnie Yee was driving her Mercedes-Benz north when she struck Fischmann near a crosswalk. Fischmann suffered major head trauma and was immediately transported to Western Medical Center-Santa Ana for treatment.

Police officials later arrested Yee on suspicion of felony driving under the influence. It is indeed an unfortunate thing that due to the negligent and intoxicated driver, a young woman is left in critical condition. Yee will most likely be found to have violated California Vehicle Code Section 23152(a) which states that “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

Fatal Mission Bay Cruise Leads to Death of La Jolla Man

San Diego’s Mission Bay had a deadly even this week when lifeguards and divers found the body of a 28-year-old La Jolla man in the bay on August 9, 2009, over 12 hours after he dove off the Bahia Belle cruise ship with two friends. He did not make it to shore and drowned.

Sean Rae and his friends jumped off of the tour boar during the night time cruise around 12:35 a.m. in the early morning of August 9, according to San Diego Lifeguard Lt. Andy Lerum. The San Diego Police Department released dive teams and joined with the Port of San Diego to search, along with a U.S. Coast Guard vessel, and even with lifeguards from the North County, to all search the waters. Before the body was found, Lerum was worried the area would be too large to search and successfully locate the body.

The Bahia Belle is a mock paddlewheel restaurant-bar cruise boat based at the Bahia Resort, which regularly cruises Mission Bay. Rae lived in La Jolla with his girlfriend.

Toddler Killed in San Diego Pedestrian Accident

A three-year-old visiting San Diego for a family event wandered into traffic on Nimitz Boulevard recently, where he suffered fatal injuries after being struck by an oncoming pickup truck, according to a recent article from The San Diego Union-Tribune.

The young boy was visiting San Diego with his family, residents of New Mexico, to celebrate the graduation of a family member from the Marine Corps Recruit Depot. Around 7:30 p.m., the boy wandered out of his family’s hotel room and toward the road. He stepped into the traffic lanes on Nimitz Boulevard near the Rosecrans Street intersection. Unfortunately, the driver of an oncoming Toyota pickup truck struck the boy, causing serious injuries.

Bystanders called emergency medical services, which rushed the toddler to a nearby children’s hospital. The boy passed away in the hospital’s intensive care unit about six hours later. The driver of the pickup truck stopped at the scene and answered police questions. Police have not said whether he was at fault for the fatal car accident or whether criminal charges will be filed.

Study Finds “Alarming” Rise in Child Injuries Caused by Falling TVs

Carlsbad DUI Hit-And-Run Car Crash Kills Elderly Bicyclist

The female motorist was later arrested on the suspicion of manslaughter, drunk driving, and hit-and-run. The driver did the double felony of not only drinking and driving but also fleeing from the scene of accident. Both these actions are a direct violation of California law.
