Hot Coffee the Movie Shows the Ill Effect of Tort Reform

Remember the McDonald’s coffee case? A woman orders a cup of hot coffee. She puts the cup in between her legs as she drives. Then, the coffee spills, and she gets third-degree burns on very private areas on her body. Cha-ching!

Though, that is not exactly the whole story. Susan Saladoff, director of the documentary film Hot Coffee, which premieres on HBO tonight at 6 p.m. PST, shows viewers what really happened in the infamous "McDonald's hot coffee" lawsuit. The movie looks at what actually happened to Stella Liebeck, why the case got so much media attention, who funded the effort, and who really profited from spilling hot coffee.

Hot Coffee is a “call to action.” It asks the question, What happens when access to court is so lopsided that the average person cannot gain access? And who really pays the price, the negligent party or taxpayers?

In the four cases the film documents, Saladoff shows how Americans are surrendering their Constitutional rights in all sorts of ways without even knowing it and how they are being screwed by the system –not taking advantage of it.

If you or someone you love has been injured or killed because of a defective product or negligent person, you are entitled to damages. The California personal injury attorneys at the Jurewitz Law Group will protect your Constitutional rights and get the money you deserve.

Pedestrian Struck And Killed In Los Angeles County Crosswalk Accident

Aurelia Arciniega, 47, was struck and killed in a fatal Los Angeles pedestrian accident that occurred on May 4, 2011, around 6 p.m. in the 6300 block of Florence Avenue. According to Coroner's Office Assistant Chief Ed Winter, the pedestrian was struck by a motorist in the Bell Gardens neighborhood of Los Angeles.

Arciniega was immediately transported to a nearby hospital for treatment and was later pronounced dead. From the limited information available, it is quite evident that the negligent driving of the motorist lead to this fatal car accident. From the facts set forth in the news story, it appears that the motorist failed to notice the pedestrian crossing the intersection in a crosswalk and hit her. In any case, striking a pedestrian legally in a crosswalk is negligence per se under California law.Under California Vehicle Code Section 21950(a), “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection….”

Our law office offers sincere condolences to all those who knew Arciniega for their loss. Teen Bicyclist Dies In Los Angeles Hit-And-Run Auto Accident

Alex Romero, 17, suffered fatal injuries in a Los Angeles bicycle accident that occurred on April 20, 2011, about 9 p.m. in the right lane of De Soto Avenue. According to Officer Rosario Herrera, a spokeswoman for the Los Angeles Police Department, Alex Romero was riding his bike on the far right lane of De Soto when a gray Toyota Corolla rear-ended his bicycle. Romero was pronounced dead at the accident scene.

The death of a young member of the family is devastating. If I were a member of his family, I would want to know how this accident took place. Who was at fault? Did the Toyota driver do enough to prevent the accident? Was he driving under influence of drugs or alcohol? If my daughter or brother had lost his life due to someone else’s negligence, I would go to any extent to ensure that the guilty was punished and that my family received maximum compensation for the loss of life—money that could be used to help family members grieve or fulfill something positive.

It would be wise for Romero’s family to seek counsel from an experienced Los Angeles bicycle accident lawyer to learn about their legal right and options, even if they ultimately decide not to file a claim. As family members of the deceased, they might be able to obtain compensation to pay for funeral and burial costs, loss of future earnings, loss of love and companionship, and other accident related damages.

Our law office offers our sincere condolences to all those who knew and loved Romero for their tragic loss.

Two Killed In San Bernardino County Car Accident

Lewis Stokes, 40, was killed in a fatal San Bernardino County car accident that occurred on April 2, 2011, around 4:37 p.m. at Interstate 15 near Bear Valley Road in Hesperia, approximately 167 miles from San Diego. Metrolink Train Accident Kills Car Driver

An unidentified man in his 70s was killed in a fatal Los Angeles train accident that occurred on November 29, 2010, around 9:35 a.m. at Francisquito Avenue, approximately 116 miles from San Diego. Sherita Coffelt of Metrolink said that train number 304 was heading from Union Station in Downtown Los Angeles to San Bernardino when it struck the elderly man’s car, killing him.

The elderly motorist was pronounced dead at the accident scene by the authorities. Two passengers in the train also suffered injuries in this train accident and were transported to a nearby hospital for treatment.

From the present facts, it is unclear as to how this train accident occurred. Did the train driver ignore a red signal? Was he distracted that he did not notice the victim’s car? At the same time was it the elderly person’s failure to observe safety signals? Was he unable to calculate the distance between his car and approaching train? If negligent operation by the train conductor caused this train accident, then the train conductor and his employer might be legally required to compensate the elderly person’s family for the cost of funeral expenses, loss of love and companionship, and other related damages. The deceased’s family would be well-advised to consult with an experienced Los Angeles personal injury lawyer who will advise them about their legal rights and options.

Dangerous Product Case Opinion Limits the Rights of Californians

The California Court of Appeals for the Fourth Appellate District recently handed down a decision in the case of Gonzalez v. Southern California Gas Company that can only be described as questionable at best and destructive to the rule of law at worst.

A young girl died after her car hit a gas meter that was along the side of the road and not properly covered as required by federal law—a law that was created due to the foreseeability of accidents like this one. The jury ruled in her favor, but the Court of Appeals decided to reverse the verdict, leaving her family without justice. What makes it worse is that the Court decided NOT to publish their opinion for official review and authority—an indication that the justices may have realized that their ruling was unsupported by existing case law.

Our San Diego injury lawyer website recently wrote a brief article detailing the events of this defective products lawsuit and why this is important to everyone to read and understand. The Court decided not to provide the public with protections that previous courts and Congress had intended gas companies to install. Please read our article on this outrageous tort reform opinion for the full story.

Riverside Bicycle Accident Kills Lake Elsinore Bicyclist

Mark Westwood, 52, was killed in a Riverside bike accident after he was hit by a sedan while riding his bicycle in Lake Elsinore. According to a report published in The Southwest Riverside News Network, this fatal bicycle accident occurred on October 2, 2010, around 7:50 p.m. This auto accident occurred on Grand Avenue near Blackwell Boulevard in Lake Elsinore, approximately 85 miles north of San Diego.

Westwood was transported to a nearby hospital for treatment where he died on the morning of October 3, 2010. An investigation is going to determine the exact cause of this bicycle accident.

It is unclear from this report what may have caused this fatal car versus bicycle collision. There are several unanswered questions in this case. Where was Westwood riding his bicycle at the time of accident? Did he or the Sedan driver fail to yield right-of-way at the intersection? Was this bike accident a result of a dangerous roadway? Was the driver distracted, speeding or otherwise negligent at the time of the collision?

In this particular case, if the sedan driver is determined to have been at fault, then he or she could be held liable for Westwood's wrongful death. Westwood’s family would be advised to contact an experienced Riverside bicycle accident lawyer, who will carefully analyze all aspects of the incident and make sure that the negligent parties are held accountable. Where negligence or wrongdoing is involved, Westwood’s family can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship and other related damages.

Drunk Driver Kills Victorville Pedestrian

Daniel Lugo, 80, was killed in an Apple Valley car accident when he was struck by a vehicle on September 18, 2010, around 7:50 p.m. Lugo was struck and killed while he was walking along Highway 18 near Tao Road in Apple Valley, approximately 95 miles from San Diego.

The car driver apparently fled from the auto accident scene after hitting Lugo. On September 19, 2010, Michele A. Pace, 36, appeared in Apple Valley Police Station and her 1994 gold Saturn car was found before she was arrested on suspicion of felony hit-and-run with serious bodily injury.

From the present facts, it is clear that Lugo lost his life due to Pace’s gross negligence due to driving under the influence of alcohol and now the investigating officers need to investigate all the facts surrounding this car accident. Under California law, it is unlawful for anyone to operate a motor vehicle under the influence of any drug or alcohol per California Vehicle Code Section 23152(a). Also, leaving the scene of an accident is a serious violation under California Vehicle Code 20001 (a). If Pace is found guilty of driving under the influence of alcohol and running from the scene of accident, then she might be held liable to pay Lugo’s family the cost of funeral arrangements, loss of earnings, loss of love and companionship, and other related damages.

We offer our sincere condolences to Lugo’s family for such a tragic and devastating loss.

San Diego Train Accident Kills Pedestrian

Roger Lee Bailey, 46, while trying to cross the train tracks in the North San Diego County city of Oceanside, was struck and killed by an Amtrak train on September 18, 2010 around 11:55 p.m. Oceanside Police Sgt. Travis Norton said that the man was trying to cross the tracks on the 200 block of Surfrider Way when he tripped and was struck by San Diego bound train.

The train stopped at the accident scene to await investigating officers from San Diego County Sherriff’s Department. The exact reason of Bailey’s presence on the tracks is not clear, although it appears that he was trying to cross the railroad track and may have been trying to “beat” the train. It is also not clear whether Bailey was under the influence of drugs or alcohol or sober when this fatal train accident occurred.

The exact cause of this injury accident still remains under investigation. If it is found that the train driver’s negligence or inattentiveness caused this fatal train accident, then he and Amtrak might be held responsible for the victim’s death and may be civilly liable to pay the cost of his funeral, loss of earnings, and loss of love and companionship. More facts are needed to determine if this is the case.

In the meantime, nothing can be said that would console or help Mr. Bailey’s friends and family in a time like this. The loss of a loved one is never easy but it is particularly hard when it happens in an accident where someone may be legally responsible for their death. Our thoughts and prayers go out to Mr. Bailey’s friends and family. We wish them peace.

Baby Killed In Huntington Beach Car Accident

A 31-year old woman along with her 11-year old daughter, and her 3-month old daughter, Ruby Gould, were struck by a car while trying to cross a marked crosswalk in Huntington Beach. This fatal pedestrian accident occurred on September 7, 2010, at the intersection of Croupier Drive and Springdale Street, approximately 91 miles from San Diego in Orange County.

According to Huntington Beach Police, a Toyota Tundra that stopped to let the pedestrians cross the street was rear ended by a speeding Chevy Tahoe that failed to stop at the intersection.

The force of the traffic collision pushed the Tundra into the crosswalk, striking the three pedestrians Unfortunately, Ruby was killed, while the mother and young girl sustained severe injuries. The boy who was walking along with the group escaped unhurt. The investigation of this car accident is pending.

Based on the present facts, the Chevy Tahoe driver will probably be found at fault for failing to stop at the intersection and provide the right of the way to the pedestrians as required by California Vehicle Code Section 21950. This California law holds that drivers must give the right of way to pedestrians in marked crosswalks and at an intersection. Violation of this law may entitle the injured woman for compensation to cover the cost of funeral arrangements for Ruby, cost of hospitalization and treatment of injuries, and other related damages.

We express our sincere condolences to all those who knew and loved the toddler for such a tragic loss. There is nothing as tragic as the loss of a child. It is just too painful to imagine. We also sincerely hope and pray that the injured victims are able to recover to their complete health soon.

Woman Killed in Carlsbad While Crossing Train Tracks

A 51-year old woman was knocked down and killed by a freight train on May 18, 2010, while she was trying to cross the train tracks. This pedestrian accident took place near Coyote’s Bar and Grill in Downtown Carlsbad near the Grand Avenue railroad crossing around 10:30 p.m.

Officials stated that the train crossing’s guard was lowered and red light flashing when the woman went under rail and stepped onto the tracks. She put her arms over her head and was trying to exit the tracks when she was hit by a northbound freight train.

The victim is believed to have been arguing with her boyfriend and seemed to be taunting him when she jumped onto the train tracks.

We offer our condolences to the woman’s friends and family. Our thoughts also go out to her boyfriend who, no matter how bad the argument, did not want to see his girlfriend die in front of him. We hope that this tragic accident serves as a reminder to everyone that trains are not to be toyed with. They are extremely dangerous and cannot slow down or stop quickly to avoid people, cars, or bikes on the tracks.

Fatal Los Angeles Pedestrian Accident Happens in Parking Lot

The Los Angeles Police reported that a man lost his life when he was hit by a woman driver who accidentally accelerated in a 7-Eleven parking lot. The pedestrian accident at Reseda and Burbank Boulevards around 9 p.m. on Monday, May 3, 2010, when the man was walking into the store to do some shopping.

Valley Traffic Division investigators remained at the car crash scene on Tuesday morning, more than five hours after the fatality to determine the cause of the traffic accident. The woman was found not to be driving under the influence of alcohol or drugs. If that is the case, then the accident is most likely due to the pedestrian suddenly entering the path of the car, the driver being inattentive, or both.

We wish the family of the accident victim our prayers and condolences. There is nothing worse than losing a loved one. Drivers should always be careful when driving to look out for pedestrians, skateboarders, or other possible sudden impediments to their car’s path. Drivers should never assume that sudden danger will not prevent themselves.

San Diego DUI Driver that Killed Mother Found Guilty

An El Cajon jury reached a verdict regarding a Nov. 21, 2009 car crash that killed 35-year old Cydil Deann Kohlmeyer. The guilty driver was sentenced for 15 years on the charges of misdemeanor hit-and-run and gross vehicular manslaughter for driving while intoxicated.

El Cajon drunk driving felony murder

The guilty, 53-year-old Deborah Felix, had fatally injured Kohlmeyer, a mother of three, while driving drunk along Pepper Drive in El Cajon. Felix had also managed to strike mailboxes and a pickup after hitting the victim. Felix will be sentenced on May 11 by El Cajon Judge Lantz Lewis. Jurors also found Felix guilty of a sentence-enhancing allegation that she had fled the scene of the accident after committing the crime. According to Felix, she wanted to urinate and had gone farther away from the scene to relieve herself. What a silly and inexcusable reason to leave the scene of the accident!

Our office is in agreement with the verdict and hope that Felix serves all of her time for taking the life of Ms. Kohlmeyer. People driving under influence should be punished harshly. We hope that other drivers learn from this, and restrain themselves from drinking and driving. If a drunk driver is unfortunate enough to cause an accident, please be responsible enough to stay at the scene and try to assist the injured until help arrives.

Riverside County Car Accident Kills Murrieta Man

A 29-year old Murrieta man died in a fatal Riverside County car accident on northbound Interstate 15 (I-15) near the Temecula Parkway. The accident happened on March 20, 2010 at around 4:30 a.m. The car crash happened primarily due to a disabled vehicle without headlights.

The victim, Miguel Vega, when his car hit the guard rail on the stretch of the downhill freeway, spun out, and stopped across two traffic lanes with no headlights. The driver of an oncoming car did not see Vega's car in the predawn darkness until it was too late to avoid the crash and struck it on the side. The car spun around and was then hit by a second car. Vega was pronounced dead at the scene.

Our office wishes to offer our heartfelt prayers and condolences to the family and friends of Vega. This accident is tragic. One wonders why Vega lost control of the vehicle in the first place and that thought will most likely haunt his friends and family. It would be reasonable to believe that, given the time the accident occurred, that Vega had fallen asleep at the wheel prior to striking the guardrail. However, nobody will ever truly know.

Regardless of the cause of the auto accident, it is a good reminder to the public to always stay alert and well-rested while driving. If you feel tired or like you are about to fall asleep, please pull over and take a quick 30 minute nap or drink some coffee and wait about 30 minutes before driving your car again.

San Diego Pedestrian Accident Kills Woman After Being Struck by Tour Bus

An Arizona tourist suffered was killed in a San Diego pedestrian accident after she was hit by a San Diego Seal Tours vehicle in Downtown San Diego on March 18, 2010. This pedestrian accident happened at West Harbor Drive and Pacific Highway around 5 p.m.

san diego tour bus kills pedestrian

According to a SanDiego6.com story, when police officers arrived on the scene, they found a young woman lying in the street. According to police, the amphibious tour bus hit her as she was crossing Pacific Highway illegally. The bus driver on the vehicle sits about 17-feet from the ground and never saw the pedestrian coming. A passenger on the bus saw the accident and yelled “Stop”. The bus driver then exited the vehicle and started to do CPR on the woman. She was transported to UCSD Hospital with serious injuries and later died.

Our office sends our prayers and condolences to the pedestrian’s family. The loss of any human life is always tragic and this accident is no exception. We once again urge all pedestrians to be vigilant while on the road, especially when you are crossing it. Always cross the road at an intersection after you have checked that no vehicle is coming. Following these simple rules can save your life.

However, many questions still remain. Why couldn't this bus driver see the pedestrian from his very high vantage point? Did the design of the bus itself block the view or diminish the driver's ability to see the pedestrian as she was crossing the road? Was the driver distracted by the other passengers in his bus?

Carlsbad Pedestrian Accident Kills Teenager

An 18-year old pedestrian lost his life in a Carlsbad pedestrian accident on March 5, 2010. The incident took place along Palomar Airport Road between El Camino Real and Camino Vida Roble, near where Carlsbad, Vista, and San Marcos intersect in North San Diego County, around 9:45 p.m.

A witness to the accident called in the paramedics immediately following the auto vs. pedestrian accident. According to reports, the man was struck by two cars as he was crossing Palomar Airport Road. The first vehicle did not stop and the driver of a second vehicle was stopped by the Carlsbad Police after it struck the man in the road. The second driver did not realize he had struck the man in the road. The Carlsbad Police is continuing investigation after inspecting the crime scene.

Our office forwards our condolences to the family and loved ones of the deceased. We also wish that the police will track down and arrest the driver of the first vehicle—the one that struck and killed this pedestrian. There is nothing more infuriating than a careless and negligent driver who causes significant injury or death who does not stop to assist the person they just hurt. We understand that it is scary when you realize that you have injured someone with your car, but there is no excuse to ever leave the scene of an accident. Your presence is necessary to contact emergency service personnel and to perhaps provide basic life saving techniques until the ambulance can arrive. When you leave the scene of an accident, you take away that hope.

Fatal Motorcycle Accidents by Marines Reduced by Nearly Half in 2009

The Marine Corps announced that it significantly reduced the number of fatal motorcycle accidents involving Marines in 2009. In 2008, the Marines reported a record high of 25 deadly motorcycle crashes. They year before, the Marine Corps 19 Marines were killed in motorcycle wrecks. However, in 2009, the total number of Marines who lost their life was reduced to only 14--a reduction of more than 40%.

San Diego has three Marine bases--Camp Pandleton, Miramar Air Station, and the Marine Corps Recruiting Depot. Camp Pendleton and MCAS Miramar accounted for 4 deaths each during 2009. In 2008, 9 Camp Pendleton Marines and 2 MCAS Miramar Marines were killed due to motorcycle accidents. No data was released for MCRD San Diego.

In the wake of the rising Marine casualties from motorcycle crashes, the USMC hired contractor Cape Fox Professional Services to provide suitable training programs to Marines in motorcycle riding and safety. In the past five years, the number of Marine motorcycle fatalities has constantly increased from 13 in 2005, to 16 in 2006, 19 in 2007, 25 in 2008, before significantly reducing to 14 in 2009. Citing the significant drop as a success of Cape Fox Professional Services, Washington has renewed their contract for the 2010 fiscal year. The Marine Corps will soon also launch an interactive website, SemperRide.com, where professionals featured in $500,000 safety movie, Semper Ride, can be contacted by Marine motorcyclists.

Our office celebrates and appreciates the effort of our local San Diego Marine community to be safe motorcyclists and hope that the new safety program will continue to reduce the number of motorcycle accident fatalities. However, two issues are still concerning. First, 14 Marines were killed due to motorcycle accidents--which is still far too many to have lost their lives. Second, 8 out of the 14 fatal motorcycle wrecks involved San Diego based Marines--that is nearly 60% of all Marine motorcycle deaths occurring in San Diego! Our office supports the Marines and their mission and recognize the risk and sacrifice they make when they put themselves in harms' way defending our country. It is therefore tragic when Marines unnecessarily lose their lives in motorcycle accidents that can be avoided.

Man Arrested in San Diego Hit-And-Run Car Wreck

A 76-year old man was arrested on February 26, 2010 for suspicion of being involved in a San Diego hit-and-run car crash in which a pedestrian was seriously injured. The injured woman, 56, had been struck by a car while walking across Market Street at 42 Street around 11 p.m. in the Mount Hope area of San Diego.

According to San Diego Police Officer David Stafford, the car's driver had run a red light when the pedestrian accident occurred. The driver then sped off, only to be later found and arrested in Santee. The driver’s name was not immediately released. The woman suffered severe injuries and was taken to a hospital.

Our office wishes a speedy recovery for the injured pedestrian. Unfortunately, pedestrians always lose when faced with cars violating their right of way. As for the arrested man, we have to say that it is really disheartening to know that he first broke ran the red light and violated the pedestrian’s right of way and, then, sped away after injuring her. At least, stop to help! The driver is now most likely facing felony hit and run charges. Prosecutors will typically charge drivers with this crime when a serious injury such as a broken bone occurs or when the victim needs surgery and the driver flees the scene of the auto accident.

San Diego Auto Accident Kills Jogger in Lakeside Area

A 35-year old jogger was killed on February 16, 2010, in a San Diego pedestrian accident when she darted into the path of an oncoming car while running with her husband and their two dogs in the East County neighborhood of Lakeside, according to authorities. The woman apparently failed to see the northbound late-model Ford Mustang when she crossed the 9400 block of Los Coches Road in the Winter Gardens area shortly before 9 a.m.

Our office wishes to convey our sincere prayers and condolences to the family and friends of the deceased. We urge the joggers in San Diego County to be more careful. It is better advised to jog in parks rather than on roads when possible. But if you are jogging on roadways, please look out for motorists who may not expect to see you run across intersections. A 38-year old bicycle rider lost his life in a San Diego auto accident when a city dump truck slammed into the cyclist on February 8, 2010 around 12:50 p.m. This tragic bike accident took place in the Oak Park area of San Diego at the intersection of 54th Avenue and Krenning Street.

san diego bicycle accident

The man, whose name was withheld pending notification from family, died right on the spot of the traffic accident and could not even be taken to the hospital. Though nobody else was injured, the cause of the bicycle accident is still unknown as reported by San Diego police Detective Gary Hassen.

Our office wishes to convey our sincere prayers and condolences to the family and friends of the deceased cyclist. It has to be said that the intersection at which the car accident took place is a very busy place. The downhill run from the College Grove Drive, that meets 54th street, is a rather dangerous one. Care has to be taken by all the residents of San Diego and especially the bicyclists that they are in total control of their vehicles in this area.

San Diego Assault and Battery Takes Life of 22-Year Old Man

An argument over a taxicab resulted in the death of a 22-year old man named LaDonte Collins, on February 2, 2010, in the 7000 block of El Cajon Boulevard in San Diego. This unfortunate San Diego assault and battery took place in the early morning hours around 4:30 a.m. in the parking lot of the Ace Budget Motel.

The fatal assault appears to have been resulted from a quarrel between the victim and another man who both wanted to hire a taxi that had just arrived to pick up a fare outside the College Area motel. The quarrel heated up and ended with the other man, whose name was not immediately available, stabbing Collins and severely wounding him. Collins was taken to Sharp Memorial Hospital, where he was declared dead an hour later. The suspect was later turned over to the homicide detectives.

Incidents like these tend to leave us shocked and angry. How unjust and inhuman is it to take away a life in a fit of rage?! Our office wishes to convey our sincere prayers and condolences to the family and friends of LaDonte Collins in such difficult times.

Fatal Vista Pedestrian Accident Suspect Turns Himself In

Providing fresh insight into the teen skateboarder killed by in a Vista hit and run car accident, a 92-year old man has turned himself in to authorities saying that he might be the careless driver. A vigil was held in memory of 15-year old Lucas Giaconelli, who lost his life in when a car struck and killed him as he was skateboarding along Thobodo Road in Vista in North San Diego County.

View more news videos at: http://www.nbcsandiego.com/video.

It was during the vigil itself that the 92-year old suspect came forward asking why the vigil was taking place. The deputy with the San Diego Sheriff's Department explained about the Vista pedestrian accident. When the deputy was finished, the man said he had been driving on the street around the time of the accident and thought he had hit a small animal. The man’s car was then examined and the damage was found to be consistent with the fatal auto accident.

It has to be said that, though we are all concerned with the way young people drive, thought also has to be given to the danger posed by senior citizens driving when they perhaps should not. Clearly, due to their age, they can sometimes cause serious threats to fellow drivers and pedestrians. In some cases, such as in this accident, their carelessness and inability to react quickly can even cause death.

San Diego County Auto Accident Victim Found in Tijuana River Valley

The body of a two year old boy was found around 1:30p.m on January 27, 2010, north of the Goat Canyon area of southwestern San Diego County. It was spotted near Hollister Street and Monument Road in Goat Canyon by a rescue worker of Desert Angels.

The body is believed to be that of the pre-schooler who had been washed away in a San Diego County auto accident in Tijuana River’s raging waters last Wednesday. Among the family of five, only the father survived. The bodies of the wife/mother and eldest daughter were found soon after, but those of his two kids--a 5-year old girl and her 2-year old brother--were missing. U.S. Border Patrol Agent Daryl Reed thinks that the recovered body might be that of the toddler.

The storm had caused the water in a local dam to overflow leading to difficulty in navigating the roads. The family was in their Honda Civic and was trying to cross the flooded road when the incident happened. Our prayers go out to the father who has had to face such a tragedy in his life.

DC Metro Railway Accident Kills Two Veteran Workers

Public transportation rail systems and trains are potentially very hazardous—not only to pedestrians and patrons but to maintenance workers working on the system. Unfortunately, this proved true yesterday when two veteran employees of Washington, DC’s Metro system--Jeff Garrard, 49, and Sung Duk Oh, 68--lost their lives as they were crushed beneath a maintenance truck.

This tragic workplace accident happened around 1:45 a.m. on January 26, 2010, near Rockville, Maryland while the workers were installing new train control equipment on the track bed. They usually ended their shift at 11:30 p.m. but were working overtime at the time. The maintenance truck that hit the victims had four employees inside it. Jim Graham, chairman of the Metro Board of Directors said that “the tragedy was a direct result of human error.”

metro trolley train accident victims

The victims were known to have impeccable track records and had not laxed in their services to Metro. With over 10,000 hours of experience between them, Garrard and Oh were fastidious and always careful. Yet, they lost their lives due to someone else’s carelessness and negligence. Both Garrard and Oh lived in Montgomery County, Maryland. Garrard is survived by a wife and teenage daughter (pictured above, photo courtesy of this Washington Post story). It is always very difficult losing a loved one. In normal circumstances it becomes hard to adjust to someone’s passing away. But if a cherished person loses his life to such carelessness, the wounds never seem to heal. Our prayers go out to Garrard’s and Oh’s family.

In addition, this is not an accident unique to Washington DC’s public transportation system. It could have just as easily happened in San Diego or anywhere in California’s many public transportation services. One has to wonder whether the late hours and long hours that the crews were working also played a factor in this industrial accident. Many times accidents like these occur when workers are fatigued.

Victim of Fatal Oceanside Auto Accident Identified

Finally, after much investigation, the identity of a man who died from an car crash in Oceanside was revealed by authorities yesterday as Richard W. Elmore. 95 years old and a widow, the San Diego County medical examiner said that Elmore was found unresponsive in his car on Friday, January 22, along the 1900 block of Henie Hills Drive in Oceanside. He was declared dead at 6:16 p.m. shortly after he was brought to the Tri-City Hospital’s emergency room by paramedics. He was given advanced cardiac life support while on the way to the hospital.

According to authorities, Elmore’s car accident and subsequent death was accidental in nature and involved serious trauma to his spine as a result of the force of the collision. Despite this, it is unknown when the car crash happened and Oceanside police are investigating the case.

This appears to be just one of the many San Diego auto accidents that could have been prevented with awareness and care when driving. It is important therefore to always remember safety and traffic rules when on the road to avoid such losses as Elmore’s case. Nevertheless, the loss of life is always tragic and we want to pass our thoughts and prayers along to Mr. Elmore’s family for their loss.

San Diego Woman Killed in Hit and Run Car Accident on SR-163

A woman's body was found near the intersection of southbound SR-163 and Interstate 8 in San Diego on Saturday morning. The woman is believed to be the victim of a hit and run car accident along the 163 freeway. California Highway Patrol closed the Hotel Circle offramp to investigate the crime scene.

There is no excuse to leave the scene of the accident when you strike and injure another human being. The quick action of another person shortly after an accident can make the difference in saving an injured person's life. People who leave the scene of the accident are selfish and are not thinking of anyone but themselves when they leave the scene of an accident. We hope that the person who struck and killed this woman will be prosecuted to the fullest extent of the law.

A concert was held on August 29, 2009,to honor and benefit a young girl who was struck by a car while on vacation and remains in critical condition even today. Rebecca Martin, 11, has been hospitalized in Southern California since August 13, when she was struck by a car while crossing the street near her grandmother's house.

She had even been inside of the crosswalk, but the car going 30 mph hit her regardless, throwing her 15-20 feet in the air before she landed on the hood of the vehicle. She had to be transported to the University of Southern California Medical Center, where she still lays in stable condition, although with a fractured pelvis, bruised lungs, and brain injury. She is still unresponsive and in a coma, and sister Victoria regularly updates her feelings on the situation via CaringBridge.org.

San Diego Pedestrian Dies One Year After 2008 Walkway Collapse

A pedestrian walkway collapse at a construction site in the East Village of Downtown San Diego has claimed its' second fatality nearly one year after the initial accident. James Barham was recently found dead after accidentally overdosing on the painkillers he took for the back and knee injuries suffered in the 2008 walkway collapse. He had been waiting for surgery to repair his injuries.

The San Diego pedestrian death occurred at a housing project site on Imperial Avenue in Downtown San Diego nearly a year ago on August 28, 2008. An astounding sixteen people were injured when the walkway, set up to divert pedestrians around the construction site, collapsed. Another victim of the accident, Tyrone Allen, also died months after the accident as a result of his injuries.

A friend of the Barham reported that his injuries had severely affected him both emotionally and physically. The Tylenol he had been taking was not enough for the pain he was experiencing and he recently went to the doctor for stronger medication and was described Percocet. Friends think he just lost track of his medication because of the pain. The accident caused him to rely on a cane to walk shortly before his death.

Los Angeles Boy Killed As He Crosses Street

A Southern California boy was killed last week when he was crossing a street in Los Angeles. The 14-year-old boy from Inglewood named Semaj Spencer was the tragic victim of this hit and run pedestrian accident. The suspect of the death has been charged with misdemeanor vehicular manslaughter and a felony count of leaving the scene of an accident.

Thompson has pleaded not guilty to his charges in an Inglewood Superior Court, however. He also reportedly turned himself into police earlier this week and was subsequently arrested in the death of young Semaj Spencer. Fatal Mission Bay Cruise Leads to Death of La Jolla Man

San Diego's Mission Bay had a deadly even this week when lifeguards and divers found the body of a 28-year-old La Jolla man in the bay on August 9, 2009, over 12 hours after he dove off the Bahia Belle cruise ship with two friends. He did not make it to shore and drowned.

Sean Rae and his friends jumped off of the tour boar during the night time cruise around 12:35 a.m. in the early morning of August 9, according to San Diego Lifeguard Lt. Andy Lerum. The San Diego Police Department released dive teams and joined with the Port of San Diego to search, along with a U.S. Coast Guard vessel, and even with lifeguards from the North County, to all search the waters. Before the body was found, Lerum was worried the area would be too large to search and successfully locate the body.

The Bahia Belle is a mock paddlewheel restaurant-bar cruise boat based at the Bahia Resort, which regularly cruises Mission Bay. Rae lived in La Jolla with his girlfriend.

San Diego City Council Takes on Pedicab Accidents and Injuries

The highly publicized death of a San Diego tourist by a pedicab driver last month has given way to new regulations being put in place on pedicab drivers by the San Diego City Council, who met on Tuesday, July 28, 2009, to re-regulate many of the rules.

The council approved a long list of changes that they find will help to improve safety as well as protect the customers. The Council also was adamant that they were not done with the regulations, and would be making more as they continued to research and find what was best to improve the entire oversight.

New regulations will cap the number of pedicabs allowed to operate in high-traffic zones, and will require drivers to display fares in a prominent location. It will also ban the three-wheeled bikes from sidewalks and streets with speed limits of more than 25 mph, unless they safely use a bicycle lane. They will no longer be allowed to take up metered parking space, and must carry proof of insurance and require their passengers to wear seat belts. All regulations will be taking effect in 30 days.

Many pedicab owners are very upset about the new laws, as it is projected to hurt their business by having to cut their workers by as much as 60 percent. Currently 430 pedicabs are legally registered to operate in San Diego, and 817 people have received operator permits to drive the pedicabs within the past year. You can read more about the San Diego City Council's hearing and proposed new laws to regulate pedicab safety in this SignOnSanDiego.com story.

Driver Not Charged in Connection with Fatal San Diego Pedicab Accident

The recent San Diego fatality that had caught hold of the community was the accident where a woman died when she fell from the wagon of a pedicab as it was riding up a street that was expressly blocked to bicycles. Witnesses observed the driver swerving his own vehicle when the 60-year-old schoolteacher from the midwest fell and injured her head, later dying in the hospital from complications of the accident.

The newest development in the story is that prosecutors declined to file charges against the driver arrested on suspicion of manslaughter for the Fourth of July accident. It is not exactly clear why they were not seeking to press charges in the fatal accident. Sukru Safa Cinar, 23, was the Turkey native taken into custody. He was released from jail Thursday night pending further investigation, according to Paul Levikow, the District Attorney spokesman. You can read more about this San Diego pedicab accident in this 10News.com story.

San Diego Motorcyclist Killed in Accident Identified

A Wednesday evening motorcycle crash in San Diego County's El Cajon last week had left one man dead who had been traveling on his motorcycle. The rider was recently identified by the San Diego Union-Tribune as 37-year-old Lance Michael Hagerty. Hagerty had been killed when his motorcycle rear-ended a pickup truck as it was attempting to turn into a driveway about 5 p.m. in El Cajon on West Bradley Avenue near Wing Avenue, according to the county Medical Examiner's Officer. Hagerty had lived and worked in El Cajon.

Hagerty was wearing a helmet at the time of the collision and was riding a newer-model sport bike, according to El Cajon police. He was taken to a hospital after the wreck, where he died. The westbound traffic on Bradley Avenue had been diverted for about five hours as investigators examiner the scene, police said. The driver of the pickup truck had not been hurt. Was Pitchman Billy Mays Killed by MTBI; Second Celebrity Head Injury Death After Natasha Richardson?

Did Billy Mays, the 50-year-old celebrity pitchman, die of a minor traumatic brain injury (MTBI) following a "hard" landing by a US Airways flight between Philadelphia and Tampa, Florida?

That is the question buzzing around the internet right now.

Mays had been flying home to Tampa after filming an OxiClean commercial in Philadelphia when the front tire of his US Airways flight exploded following the hard landing. Initially no serious injuries were reported and Mays posted on his Twitter feed about the hard landing saying it was par for the course with US Airways. After the landing, objects fell from the ceiling, although it is unclear what those objects were, and hit Mays in the head.

After landing, Mays told a local news crew about the hit to his head:

"All of a sudden as we hit," Mays said. "You know it was just the hardest hit. All the top...you know the things from the ceiling started dropping and it hit me on the head, but I got a hard head."

Mays was found dead at his home the next day by his wife, Deborah. Reportedly, Mays did not feel well when he went to bed later that night. No other major health problems have been disclosed.

Victim's Family Seeks to Educate About San Diego DUI Car Accidents

In January of 2006, Derek Ritter was only 48 years old when he was hit by a San Diego car driver high on methamphetamines, killing Ritter and leaving behind a fatherless family. Now, his surviving children are determined to publicize the tragedy, and bring light to the consequences of driving while under influences.

Ritter's children, son Kevin and daughter Kara, are fighting to keep influenced drivers off the road, and to let those who hand them the keys and allow them to drive be held responsible as well. Kara Ritter has a strong viewpoint on this matter. "Everybody in society has a role to be responsible, and if you make an irresponsible decision you need to be held accountable," she says.

Dean Osuna was the man driving on meth down Highway 78 when he crossed the median and killed Ritter. Though he spent time in jail, a jury now says that Osuna and his girlfriend, who had given him the keys to drive, owe Ritter's family $1.8 million. The Ritters' attorney is very adament and pleased with this scenario, as he sees it as a precedent-setting decision to hold the driver and his enabler accountable, and will affect future generations who may make similar poor decisions when hitting the road. California Senate Reviews Boating Under the Influence Bill

The Daily Point of Orange County reported last Thursday, March 12 that the California State Senate is reviewing a new bill that would allow California and San Diego authorities to treat boating under the influence in our San Diego waters just like they would treat driving under the influence on our San Diego roads. If passed, the bill would allow San Diego and California authorities to suspend boaters' licenses if caught boating under the influence. You can learn more in this Daily Pilot story.

The California BUI bill was introduced by California State Senator John Benoit that represents Senate District 37, just north of San Diego County. Senator Benoit's bill will give the DMV the power to treat a BUI just as they would treat a DUI. Previously, the DMV had the power to do just that but last year, a court of appeals verdict deemed that they did not have the power to do so.

San Diego harbor officials and officials in other California counties would like to see the bill passed. They believe that even though boating is a recreational activity, there are still many responsibilities that a boater has. According to the California Department of Boating and Waterways there were 55 boating accident fatalities in 2007, half of which happened in Southern California. Also, about 20 of the 55 victims were intoxicated.

Arthur Newman Faces A Year In Jail If Charged With Death Of Bicyclist Walter Joller

Arthur Newman has been charged with misdemeanor vehicular manslaughter for causing a San Diego bicycle accident back in January when his car ran into Water Joller, an experienced Rancho Bernardo bicyclist. According to a Gina Coburn, a spokeswoman for the San Diego City Attorney's Office, the 55-year-old Newman faces a year in San Diego County jail if he is found guilty. You can read more in this North County Times story.

San Diego police Detective John Leterrie said that on January 6, Newman was driving a black BMW on Sabre Springs Parkway when he veered into the bicycle lane and hit Joller, 55. The bicyclist was thrown from his bicycle and San Diego medics were not able to save him.

Newman did wait at the scene and after a crash reconstruction was only accused of simple negligence instead of gross negligence. Simple negligence means that he was not found to have been distracted nor under the influence. Newman may have just briefly taken his eyes off the road. Felony vehicle manslaughter is charged when the driver is acting in an obviously risky way.

Newman is expected to appear in San Diego Superior Court for arraignment of April 24. He has also been charged with driving in a bicycle lane.

The fact that Newman waited at the scene and took responsibility is something to be admired given that he had gravely injured Joller. Also, it should be taken into account and credit should be given to Newman for not acting irresponsibly while driving. However, a 55-year-old bicyclist was killed because of Newman's brief carelessness, and so, Newman should face some sort of punishment.

If you or someone you know from the San Diego bicycling community has been injured or killed in a bicycle accident please contact the San Diego bicycle attorneys at the Jurewitz Law Group at 619-233-5020 or contact them online here.

Jens Roger Noet Identified as Man Killed in Ramona Pedestrian Accident

Yesterday we posted a story about an unidentified pedestrian killed in Ramona car crash. Our post can be found here. That pedestrian turned out to be Jens Roger Noet, a 34-year-old man, or, according to 10 news, a "transient." Noet was headed down Main Street between Fifth and Sixth Streets in Ramona on Wednesday when he was fatally struck by a semi-truck.

This information was brought to our attention through 10 news and our hats off to them for providing the story (found here), which helps remind San Diego residents about being cautious when walking next to a street and also when driving. However, it is very unnerving to see that they have the audacity to tag him, not once. but twice as a "transient." Jens Roger Noet was just killed by a truck driver and instead of writing a tactful article about the events they instead belittle him.

As stated yesterday, if the Jurewitz Law Group was asked to represent the pedestrian's family, our lawyers would work diligently to discover the facts about the accident and give Noet, a member of our community, the respect he deserves.

San Diego Wrongful Death Verdict to be Reviewed by California Supreme Court

A San Diego jury awarded the widow of a motorcycle rider and his two children $4.9 million after he was struck on a motorcycle by a truck driver. After the verdict was read, the judge--as is typical--polled the jurors for their votes. However, the judge forgot to get the answers from one juror to two of the 13 questions asked during the polling process.

The juror did agree with the other jurors that the truck driver was negligent and caused the trucking accident. However the judge forgot to ask him if he agreed with the other jurors on the apportionment of damages. The jury verdict found to the truck driver to be 80% responsible for causing the accident but also found the motorcycle rider to be 20% responsible.

On appeal by the insurance defense counsel for the truck driver, the judge's mistake led to a reversal of the verdict by the Fourth District Court of Appeals. The Court of appeals held, in part, that:

...the trial court erred in accepting the juror declarations to inquire into and resolve the results of the jury's decision making process, and also when it made a credibility determination that Santana could not effectively have voted other than 80/20 at any relevant time.

The Keeners, the family of the motorcyclist, have appealed to the California Supreme Court to reinstate the jury verdict.

The entire Court of Appeal opinion can be read here.

Ramona Pedestrian Killed After Being Hit by Truck

An unidentified pedestrian, in the Ramona section of San Diego, was killed after being hit by in a semi-truck accident Wednesday morning while crossing the street.

The accident happened just after 2:30 a.m. when the driver of the truck was heading west on Main Street at the intersection with 7th Street. According to the driver, the pedestrian appeared to come out of nowhere and appeared in front of the truck. The truck driver stopped after the impact and found the man’s body pinned under the truck.

Both lanes of Main Street were closed until 5 a.m. while the California Highway Patrol investigated the accident. At the time of publishing this entry, the cause of the accident was still under investigation.

If our office was approached by the pedestrian's family, we would first have to determine what happened that early morning. We would hire a professional accident investigator and private investigator to track down witnesses and to document the facts of the accident, including sight lines for the truck driver, the traffic controls available at the intersection, and obtaining witness statements. If the pedestrian was in the crosswalk, had the right of way, or even if the driver was not paying attention while he was driving, the pedestrian's family might have a strong case for their wrongful death claim.

Pedestrian Mohamed Abdirahman Husien Struck By Car And Killed On Way to Services in San Diego

Early Saturday morning, an unlicensed driver struck and killed a pedestrian, Mohamed Abdirahman Husien, while he was crossing the street in San Diego. The car accident occurred along University Avenue, near Winona Avenue, in the City Heights neighborhood of San Diego. Husien was on his way to morning prayer services at a nearby mosque. The news source for this post can be found here.

San Diego Police officers said that Husien was crossing the street against a red light when a Honda sedan hit him. The driver said that he did not see Husein crossing in the darkness. Also, right after the crash, the driver went home, picked up his wife, and returned to the scene to explain what had happened. This is illegal in California--you cannot leave the scene of a California car accident where someone is killed and you must call the police.

Husien was taken to Scripps Mercy Hospital in Hillcrest where he passed away.

The intersection of University Avenue and Winona Avenue was closed to motorists until about 9:30 a.m. while the San Diego Police Department investigated the car crash. San Diego Police officers said that they do not know whether the driver will face charges or not, even though he was illegally driving without a driver's license.

Unfortunately, it is not uncommon for the police and district attorney not to charge an unlicensed driver involved in a serious accident where some facts suggest that the unlicensed driver may not be at-fault for causing the car wreck. According to the news story, it seems Husein may have been at-fault for crossing against a red stop light. Then again, that fact may not be true since the only witness identified in the story is the unlicensed driver. Obviously, it is a very self-serving statement.

FDA Issues Warning to San Diego About the Psoriasis Drug, Raptiva

The Food and Drug Administration has issued a warning to San Diego doctors specializing in dermatology and patients about the psoriasis drug efalizumab, or Raptiva. This warning is linked to three deaths and possibly a fourth.

The three that were confirmed dead were all taking the drug Raptiva and were reported to have had a rare brain infection called progressive multifocal leukoencephalopathy (PML). In October of 2008, the FDA forced the drug maker, Genentech to highlight in a warning regarding the risks of life-threatening infections, including PML, on their product packaging.

The FDA has also directed Genentech to develop a Risk Evaluation and Mitigation Strategy to ensure that patients receive risk information about Raptiva. Also, the FDA wants to make sure that the risks do not outweigh the benefits.

San Diego Police Office Killed in Head-On Motorcycle Crash

A San Diego Police Officer was killed when he was involved in a San Diego motorcycle accident on February 19, 2009, according to this story.

San Diego Police Department Detective Larry Steward was riding his motorcycle on Highway 94 near Marron Valley Road in San Diego County when an SUV hit his motocycle head on. The California Highway Patrol says that the SUV swerved to avoid traffic from a CalTrans construction zone.

This unfortunate car crash should serve as a reminder to all San Diego and California drivers that they need to be cautious when driving in a construction zone. However, Detective Steward might not have died if CalTrans' construction scene was not properly organized and safe for passing drivers. It is a little too early to tell at this point, but if I were to investigate this accident, I'd be very curious as to what specifically caused the SUV driver to swerve and why. If CalTrans had loose equipment where it should not be, or did not properly warn motorists of the danger, CalTrans' might bear some responsibility for Detective Steward's death.

Defective Products: 4-Year-Old Mission Viejo Girl Dies in Washing Machine

4-Year-Old Kayley Ishii of Mission Viejo, California was killed at her home after she climbed into a front loading washing machine which was then turned on by her 1-year-old brother. Kayley Ishii was inside the water filled washing machine for approximately 2 minutes before she was found by her mother. She was taken to Mission Hospital Regional Medical Center but later died from her injuries.

It is unbelievable that a 1-year-old could turn on a washing machine without any assistance from an adult. However, the power button for the machine was located less than 20 inches above the ground and within easy reach of the toddler. That would seem to be a very reckless and negligent design defect for this product. Combined with the fact that children could easily climb inside it and you have a combination of tragically poor design defects.

If the product design is defective, California law requires that the manufacturer be "strictly liable" (meaning that they can be held responsible even though the manufacturer acted reasonably) for Kayley Ishii's death.

The Jurewitz Law Group sends it prayers and thoughts to the Ishii family. Nothing is more tragic than losing a child, particularly under such tragic circumstances.

California Teenager Killed in Jet-Ski vs. PWC Collision

Saturday morning, Lauren Taguchi, 17, of Northridge was killed when her jet-ski collided with another personal watercraft on the Colorado River in Riverside County.

Ms. Taguchi died after her jet-ski struck the other personal water craft head on. The other operator, Ricky Scott Ledford of Las Vegas, helped Ms. Taguchi to a boat ramp where first responders performed cardiopulmonary resuscitation. She was taken to Palo Verde Hospital where she later died of her injuries.

Jet-ski accidents are unfortunately fairly common and typically very serious. California has yet to require operators to obtain licenses to operate jet-skis and, although it is unknown whether inexperience was a factor in this case, the number one cause of jet-ski accidents is operator error due to inexperience.

Our prayers go out to Ms. Taguchi's family and we hope that the California legislature looks to this case as yet another example of why jet-ski operating licensing is necessary.

Mr. Willis was driving the car at 65 mph in a 25 mph residential zone when he ran the stop sign at 20th Street, the car bottomed out, crossed the southbound lanes of traffic, hit a parked car, then hit a tree, and spun around before striking another parked car in a driveway.

Dillahunty was pronounced dead at the scene. Mr. Willis, who was not wearing a seatbelt at the time, was partially ejected from the rear window of the car. He remains in critical condition at Scripps Memorial Hospital in La Jolla. Accident investigators believe Mr. Willis was driving under the influence of alcohol at the time of the accident.

If Mr. Willis was indeed driving his car under the influence, we hope that he is prosecuted for vehicular manslaughter. In addition, we hope that Mr. Dillahunty's family is compensated for his wrongful death.

Man Charged with Vehicular Manslaughter in Death of Orange County Teen

The Orange County DA filed felony charges against Jeffrey Woods, 20, of Huntington Beach last week in connection with the death of Danny "Oatie" Oates, 14. Mr. Woods is being charged with vehicular manslaughter and driving under the influence when he ran his truck into his victim as he was crossing the street on his bicycle.

Woods' conduct, if not mitigated by any other facts, is truly reprehensible and clearly gross negligence. Woods was driving his truck under the influence of alcohol and drugs while trying to score more drugs during a three-day period. Documents filed with the criminal court show that Woods may have even be texting while driving under the influence at the time of the accident. What was so important that he had to text his contact? Woods needed more drugs.

We commend the Orange County DA for pressing charges against Woods and hope that he is prosecuted and sentenced to the fullest extent of the law. Unfortunately, tragic car accidents happen every day due to drunk or inattentive drivers resulting in serious injury or wrongful death. At times like these, victims' families need the help of experienced, aggressive representation to obtain the maximum recovery for their injuries or loss.

If you or a loved one is the victim of a drunk or inattentive driver, call the Jurewitz Law Group as soon as possible to learn about your rights and remedies. We can help find medical treatment and long-term care assistance while we prosecute your case aggressively.

Third Wrongful Death Suit Filed in California Against Singer Brandy

The December 30, 2006, accident on the San Diego Freeway involving singer Brandy has spawned its' third wrongful death lawsuit related to the death of Awatef Aboudihaj.

Aboudihaj's husband, Marouane Hdidou, has filed a wrongful death claim against Brandy. Hdidou's lawsuit joins two prior lawsuits filed on behalf of Aboudihaj's parents and her two children.

The accident, took place on the San Diego Freeway, leaving Aboudihaj dead and several other motorists severely injured. California Highway Patrol has told prosecutors that Brandy should be charged with misdemeanor manslaughter for causing the multi-car collision. According to police, Brandy was traveling at 65mph, failed to notice that traffic had slowed, which caused her to hit Aboudihaj’s Honda with her Land Rover. The Honda then hit another car, struck the center divide, and was hit by Mallory Ham’s car. According to Ham, she was trying to avoid another vehicle that had gone into her lane.

Ham is also named in the lawsuit. 20 other unnamed "Doe" drivers may also be named. Hdidou alleges that these drivers were driving too vast and following too close for conditions.
