2 Bicyclists Struck in Separate Car Crashes

Two cyclists, a 10-year-old girl and a 23-year-old woman, are recovering from injuries they sustained after being hit by vehicles in two different auto accidents in San Diego.

The 10-year-old girl was riding eastbound on Catalina Boulevard at about 7:20 a.m. Tuesday when a 2011 Chevy van turned the corner on Wilcoz and hit her at the intersection. Despite what most people think, the young girl knows how to ride and was doing it safely. She competes in triathlons for kids and was riding in front of her dad, who was training with her. Her father barely avoided the collision.

The girl was taken to the hospital for a fractured leg and collar bone.

The 23-year-old woman sustained non-life-threatening facial fractures when a Hyundai SUV tried to pass her on the 4900 block of College Avenue, near Cresita Drive, at about 5:30 p.m. on Tuesday. The 55 year-old SUV driver was obviously in too much of a hurry to wait until it was safe to pass.

Both drivers’ negligent driving caused these bicycle accidents, and they may be held liable for the damages, including medical bills, loss of income, etc. The victims’ family should immediately seek counsel with a San Diego County bike collision attorney to learn about how to get the compensation they need to cover these expenses.

San Diego Police Officer Frank Cali stated that the victim was attempting to cross Arey Drive around 10:30 a.m. on April 16, 2011, when she was hit by a BMW car travelling east towards Picardor Boulevard.

The injured woman suffered a serious head injury and was immediately transported to a nearby hospital for medical treatment. Elderly Man Crashes Car Into La Mesa Store

An unidentified elderly man crashed his car into the wall of Cost Plus World Market in La Mesa on November 17, 2010. The elderly car driver said that his foot hit the accelerator and the car went in reverse. It appears that the man did not realize that his car was in reverse and was attempting to drive forward. According to witnesses, the elderly car driver crashed into three mailboxes and parts of a concrete wall before his car came to rest against the wall.

The auto accident raises several concerns that are often mentioned about elderly drivers. Even assuming that the elderly driver did not realize his car was in reverse, why didn’t he remove his foot from the accelerator and apply the brake as soon as his car went backwards? Why did it take a concrete wall to stop the vehicle? Presumably, if the car did not collide with the wall it would have kept on traveling and could have struck and killed or injured pedestrians or other motorists. Should elderly drivers be tested more frequently? Should elderly drivers be allowed on the road past a certain age? After their motor skills deteriorate to the point when they don’t realize which direction they are going? Or after they cannot apply the brakes quickly? These are legitimate questions but have to be tempered with the desire of elderly drivers to remain independent and be able to commute on their own as needed.

We are very thankful that no other motorist or pedestrian was injured in this La Mesa car accident.

Pedestrian Injured In San Diego Car Accident

An unidentified pedestrian, believed to be in 40s, was struck by a wrong way motorist on November 20, 2010, in the Midway District of San Diego around 8:45 p.m. San Diego Police officers said that a male driver driving a Ford Ranger on Rosecrans made a prohibited U-turn to drive the wrong way on Kurtz Street and struck the pedestrian, seriously injuring him.

The injured pedestrian was transported to UCSD Hospital to receive treatment for a broken thighbone. The investigating officers need to locate the guilty motorist to bring him to justice. Elderly Pedestrian Injured In San Diego Car Accident

An unidentified 71-year-old pedestrian was struck by a car twice on November 20, 2010, in the Normal Heights area of San Diego around 7:15 a.m. According to San Diego Police Sgt. Ray Battrick, the elderly pedestrian was walking on the sidewalk in the 4100 block of 33rd Street when a car backing out of a driveway hit him.

The car driver, after hitting the pedestrian, thought he hit a trash can, so he pulled the car forward and then again hit the pedestrian. The elderly pedestrian suffered injuries to his hip, legs, and ankle in this serious pedestrian accident.

The elderly pedestrian was immediately transported to a nearby hospital for treatment. The 30-year-old car driver was later cited for not possessing a valid driving license.

From the present facts, it is pretty evident that car driver’s negligence and inattentive driving lead to this major pedestrian accident that injured the elderly man. It is surprising that he did not notice a man and thought he hit a trash can! Since he did not possess a driving license, it would be interesting to know if he was even qualified or trained to drive a car. Further, it would be interesting to determine if he was driving under the influence of alcohol or any other drug. Certainly the car driver could be held liable for the pain and suffering that the pedestrian went through as well at the cost of medical treatment, hospitalization charges, lost wages, and other accident related damages.

The elderly pedestrian would be well served by consulting with an experienced San Diego pedestrian accident lawyer who would be able to advise as to his rights and make sure that he receives the compensation that he deserves.

We sincerely hope and pray that the elderly man did not sustain any life threatening injuries and that his injuries heal soon.

Spring Valley DUI Car Accident Seriously Injures Man

One man suffered serious injuries when he was struck badly by a suspected DUI car driver in Spring Valley, a East San Diego County community, on October 16, 2010, around 11:00 a.m. According to California Highway Patrol officer Brian Pennings, Colin Eisner, 33, driving a Ford Contour struck a Toyota Tacoma on State Route 125 (SR-125) close to Jamacha Boulevard.

Pennings said that the Tacoma rolled over several times while the Ford went down an embankment after the crash. The pickup driver suffered serious injuries and was transported to a nearby hospital for treatment. Eisner fortunately escaped unhurt and was arrested on suspicion of DUI.

From the facts of the story, it appears that Eisner’s negligence lead to this major San Diego car accident. According to California Vehicle Code Section 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle."

Bicyclist Injured In Rancho Bernardo Hit And Run Car Accident

A bicyclist suffered serious injuries in a San Diego hit and run car accident that occurred on October 15, 2010, around 8:00 p.m. According to the San Diego Police, this auto accident occurred on Pomerado Road near the intersection with Caminito Vecinos.

San Diego Police Officer David Stafford said that the injured bicycle rider, a man in his 40s, was riding his bike when he was struck from behind by a car near. The bicyclist suffered a fractured vertebrae, along with several bruises and scrapes. Stafford said that the bicycle rider had a six pack of beer in his bag, had been drinking, and would not provide his personal information to the investigating officers..

The investigating police officers believe that the damaged pieces of the hit and run vehicle will provide some clue about the car and help them trace the owner. From the present facts, it is clear that the hit and run car driver struck the bicyclist, whether or not the bicyclist was impaired or driving carelessly. The bicyclist here has also violated California Vehicle Code Section 23152(a) which states that “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” This law applies regardless of whether you are operating a motor vehicle or a bicycle.

The investigating officers need to determine why this San Diego motor vehicle accident occurred. From the facts reported, it appears that both the driver and bicyclist share some responsibility for causing the traffic accident. First, the car driver by fleeing from the accident scene showed irresponsible behavior and if found guilty will be held liable, in part, for the cyclist’s injuries. Leaving the scene of an injury accident is a serious violation under California Vehicle Code 20001. The bicyclist, even if partially responsible for causing the accident, can seek compensation for the cost of medical treatment, hospitalization costs, and other accident related damages. The degree to which the bicyclist is responsible for causing his own injuries will reduce his recovery through the legal theory of comparative negligence.

We recommend the injured cyclist seek assistance from an experienced Rancho Bernardo bicycle accident lawyer who could help him get a fair compensation for the injuries hesuffered. We sincerely hope that the injured bicyclist did not suffer any life threatening injuries and recovers From his injuries soon.

Woman Rescued from San Diego Rollover Auto Accident

An unidentified woman was rescued from her overturned car around 11:10 a.m. on August 28, 2010, and was immediately rushed to a nearby hospital with injuries. According to the San Diego Fire and Rescue Department, the exact reason of how the woman’s vehicle flipped near the intersection of 54th Street and Chollas Parkway in Chollas Creek was unclear.

San Diego Fire and Rescue Department officer said that traffic was blocked from the intersection where police were conducting an investigation to determine why the vehicle rolled over.

If the car overturned due to any mechanical failure or an unkempt road, then the automobile manufacturer or the authorities responsible for maintenance of the road might be held liable to pay a compensation for the injured victim’s medical costs and pain and suffering damages. As with any person who has been injured in an auto accident, the injured woman would be wise to consult with a San Diego personal injury lawyer who can advise her of legal rights and help her get a fair compensation.

We sincerely hope and pray that the injured victim recovers to her complete health soon.

Driver Under the Influence Collides with San Diego Firefighter Truck

Yesenia Mitre, 25, collided with a firefighters’ truck and left four firefighters injured. The truck was on its’ way to answer a medical emergency on the morning of June 13, 2010. According to reports, Mitre drove out directly in the lane of traffic the fire truck was travelling in close to Alpine in eastern San Diego County. Due to the collision, the fire truck lost control and hit a pole.

According to the San Diego 6 news report, Mitre was driving under the influence and was arrested. The four firefighters sustained serious injuries while Mitre sustained a broken wrist.

It is indeed an unfortunate thing that due to the negligent and intoxicated driver, the four firefighters were badly injured. It is absolutely insane that instead of giving way to the emergency truck, Mitre drove right into its path. Mitre will most likely be found to have violated California Vehicle Code Section 23152(a) which states that “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” Under California law, it is also illegal to drive a vehicle with a blood alcohol content of 0.08 percent or higher.

Woman Killed in Carlsbad While Crossing Train Tracks

A 51-year old woman was knocked down and killed by a freight train on May 18, 2010, while she was trying to cross the train tracks. This pedestrian accident took place near Coyote’s Bar and Grill in Downtown Carlsbad near the Grand Avenue railroad crossing around 10:30 p.m.

Officials stated that the train crossing’s guard was lowered and red light flashing when the woman went under rail and stepped onto the tracks. She put her arms over her head and was trying to exit the tracks when she was hit by a northbound freight train.

The victim is believed to have been arguing with her boyfriend and seemed to be taunting him when she jumped onto the train tracks.

We offer our condolences to the woman’s friends and family. Our thoughts also go out to her boyfriend who, no matter how bad the argument, did not want to see his girlfriend die in front of him. We hope that this tragic accident serves as a reminder to everyone that trains are not to be toyed with. They are extremely dangerous and cannot slow down or stop quickly to avoid people, cars, or bikes on the tracks.

San Diego County Bus Crash Injures 11 Children

A school bus accident on the Campo Indian reservation has left eleven children hurt, according to San Diego County’s authorities. State Fire Department spokesperson Mike Mohler said that the bus struck a light pole at approximately 8 a.m. causing the bus to crash. Mohler said that all the eleven children were immediately taken to a local hospital and ten out of them have been released after treating their moderate injuries.

According to the California Highway Patrol, this bus accident occurred in the parking lot of the reservation’s Golden Acorn casino. The reservation is located about forty miles south-east of Downtown San Diego.

Our office wishes for all the injured children to reach a full recovery. It is hard to imagine that the bus driver failed to pay such attention to his job that the bus struck a light pole. One would think that a driver charged with the safety of kids would be more careful while operating a vehicle.

San Diego County Auto Accident Victim Found in Tijuana River Valley

The body of a two year old boy was found around 1:30p.m on January 27, 2010, north of the Goat Canyon area of southwestern San Diego County. It was spotted near Hollister Street and Monument Road in Goat Canyon by a rescue worker of Desert Angels.

The body is believed to be that of the pre-schooler who had been washed away in a San Diego County auto accident in Tijuana River’s raging waters last Wednesday. Among the family of five, only the father survived. The bodies of the wife/mother and eldest daughter were found soon after, but those of his two kids--a 5-year old girl and her 2-year old brother--were missing. U.S. Border Patrol Agent Daryl Reed thinks that the recovered body might be that of the toddler.

The storm had caused the water in a local dam to overflow leading to difficulty in navigating the roads. The family was in their Honda Civic and was trying to cross the flooded road when the incident happened. Our prayers go out to the father who has had to face such a tragedy in his life.
