Santa Ana Pedestrian Accident Caused by Unlicensed Driver

A mother and her 4-year-old child were struck and injured by a car driven by an unlicensed car driver in Santa Ana on the morning of October 20, 2010. Santa Ana Police Cpl. Anthony Bertagna said that this Orange County auto accident occurred along the 1200 block of East McFadden Avenue, near Grand Avenue in Santa Ana, approximately 125 miles north of San Diego.

Eric Christopher Woodward, 39, driving a Ford Crown Victoria, veered onto the sidewalk and hit the mother and crushed the child. The impact of the car crash was so strong that both the mother and child were thrown about 20 feet into the air. Bertagna said that the child suffered critical injuries and the mother suffered a broken shoulder.

Woodward lost control of the vehicle, perhaps due to experiencing a grand mal seizure, and in an effort to compensate the curve he struck both the mother and the child leaving them seriously injured. Bertgana said that Woodward was unlicensed due to his propensity to experience seizures. Fortunately, Woodward and his mother riding as her passenger escaped unhurt.

Church Street Car Accident Injures Roseville Woman

An unidentified 20-year-old Roseville woman suffered critical injuries in a Placer County car accident that occurred on October 17, 2010, around 3:02 p.m. on Church Street in Placer County, 400 miles from San Diego. Roseville Police Department officers said that the injured woman driving her 1989 BMW Sedan failed to negotiate a curve near Circuit Drive.

The BMW failing to take the curve, collided with a tree and then with the Union Pacific Railroad Yard property. Injured female driver was immediately transported to Sutter Roseville Medical Center for treatment.

Authorities investigating this serious car accident believe that slippery road might have contributed to it. Alcohol and drugs are not believed to be factors behind this car accident. Big Rig & Bus Crash Closes Highway 12 In Sacramento County

A big rig versus bus accident closed Highway 12 on October 11, 2010, afternoon in Sacramento County. According to the California Highway Patrol, this fatal Sacramento interstate trucking accident involved two other vehicles: a bus and a Chevy Blazer SUV. Stockton CHP spokesman Angel Arceo said that this three vehicle accident occurred on State Route 12 just east of the Sacramento-San Joaquin County line and south of Isleton, approximately 400 miles from San Diego.

Arceo said that the big rig truck and tractor trailer was traveling westbound when it encountered traffic, tried to slow down, and jackknifed. A transit bus carrying no passengers heading eastbound slammed into the big rig. The female drivers driving big rig and the transit bus suffered critical injuries and were transported to a nearby hospitals for treatment. The big rig truck driver was taken to John Muir hospital in the Bay Area, while the bus driver was transported to the UC Davis Medical Center.

The SUV involved in this truck accident, went down an embankment off the road, but fortunately no one suffered major injuries. This Sacramento truck accident forced closure of Highway 12 in both directions. The roadway reopened after 7:45 p.m.

Bicyclist Killed In Los Angeles Hit And Run Car Accident

A teenager was killed in a Los Angeles County bicycle accident that was caused by a man driving under the influence of alcohol on October 2, 2010, around 2:11 a.m. The teen boy was riding his bike when a 2007 Saturn driven by Shawn Fields, 26, struck him. This car accident occurred at the intersection of Laurel Canyon Boulevard and Chamberlain Street in Pacoima, approximately 100 miles north of San Diego in the San Fernando Valley.

The teenaged boy was thrown off his bike across the intersection. Fields fled from the accident scene but was later tracked down by the authorities with the assistance of witnesses. The injured bicyclist was transported to a nearby hospital where he succumbed to his injuries. According to officials, Fields was driving under the influence at the time. That could have been the reason why he fled from the accident scene without even stopping to help the injured teenager, who was lying in the middle of an intersection. Chula Vista Pedestrian Accident Injures Partygoer

One person suffered serious injuries when he was struck by Juan Zermano, 23, with his car outside a party in Chula Vista around 1 a.m. on October 3, 2010. According to the Chula Vista Police, Zermano was arrested on suspicion of felony drunken driving and assault with a deadly weapon. This Chula Vista pedestrian accident occurred near the intersection of Fourth Avenue and Moss Street in Chula Vista, a city in South San Diego County.

Chula Vista police Lt. Fritz Reber said that a 16-year-old boy, who was part of an argument, called his brother, Zermano, to pick him up. Zermano picked up his brother and others, and drove away from the argument. He then made a sudden U-turn, drove up on the curb, and struck the victim badly.

The injured victim was taken to UCSD Medical Center for treatment from where he was released after two hours. If Zermano is determined to have been at fault in this case, then he could face not only criminal DUI charges and charges of assault with a deadly weapon (using his truck as a tool to attack and strike the victim), but could also be held financially responsible for the injuries and damages he caused. Porterville Man Suffers Injuries In A Strathmore Car Accident

Joshua Plunk, 32, from Porterville sustained major injuries in a Strathmore car accident that occurred on September 27, 2010, around 6:40 p.m. According to the California Highway Patrol, this auto accident occurred when a 2007 Honda Accord collided with the 2004 Ford F-250 which Plunk was driving east of Strathmore, approximately 200 miles north of San Diego.

Plunk was driving his pickup truck eastbound on Avenue 196 when a westbound Accord driven by Dustin Reed, 24, initiated a left hand turn into the path of the pickup truck at Road 256. Plunk suffered major injuries in this car accident and was transported to Kaweah Delta Hospital in Visalia for treatment. Two other passengers in the pickup truck, Danny Delussa, 38, and Rhett Mason, 29, sustained minor injuries in this car accident.

The Accord driver, Reed, fortunately escaped unhurt. This traffic collision appears to be caused by an unsafe left-turn initiated by Reed, who failed to yield to the right-of-way to Plunk’s Ford truck. The law that applies to left turns is stated in California Vehicle Code Section 21801: "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."

Huntington Beach Auto Accident Injures Driver

A 38-year old man suffered critical injuries in an Orange County car accident that occurred at Goldenwest Street on September 28, 2010 around 6:00 p.m. According to Huntington Beach Police Lt. Gary Faust, the injured victim was thrown out of his pickup truck after it collided with a BMW.

Faust said that the pickup truck rolled over and the man was thrown out of it. The injured man suffered serious head and internal injuries and was transported to UCI Medical Center for treatment. The BMW driver also complained of pain and was taken to a nearby hospital for treatment. The names of both the car drivers have not been released.

Police are still investigating the cause of this car accident to determine who was responsible for causing the accident, but it is believed that one of the drivers might have crossed into the intersection against a red light. Los Angeles County Motorcycle Accident Kills Softball Coach

Fred Fraijo, 49, a Northview High School softball assistant, was killed in a San Gabriel Valley motorcycle accident on the 10 Freeway (Interstate 10, I-10) in San Dimas in east Los Angeles County, approximately 120 miles north of San Diego. According to the California Highway Patrol, this fatal Los Angeles motorcycle accident occurred on September 22, 2010, around 5:20 a.m.

At the time of the motorcycle accident, Fraijo rode his 2004 Harley-Davidson motorcycle and crashed it into a big-rig truck parked on the shoulder. Fraijo was pronounced dead at the scene.

San Bernardino County Auto Accident on I-15

Vannity Joy Lewis, 18, was killed and four others suffered serious injuries in a San Bernardino County car accident that occurred on September 19, 2010, around 5:15 p.m. According to the San Bernardino County’s Coroner’s Division this fatal auto accident occurred on Interstate 15 (I-15), approximately 95 miles from San Diego.

Lewis was travelling in a 1997 Volkswagen Jetta southbound on Interstate 15, south of Baseline Road.

Drunk Driver Kills Victorville Pedestrian

Daniel Lugo, 80, was killed in an Apple Valley car accident when he was struck by a vehicle on September 18, 2010, around 7:50 p.m. Lugo was struck and killed while he was walking along Highway 18 near Tao Road in Apple Valley, approximately 95 miles from San Diego.

The car driver apparently fled from the auto accident scene after hitting Lugo. On September 19, 2010, Michele A. Pace, 36, appeared in Apple Valley Police Station and her 1994 gold Saturn car was found before she was arrested on suspicion of felony hit-and-run with serious bodily injury.

From the present facts, it is clear that Lugo lost his life due to Pace’s gross negligence due to driving under the influence of alcohol and now the investigating officers need to investigate all the facts surrounding this car accident. Carlsbad Auto Accident Pins Woman Between Two Cars

Riverside County Motorcycle Accident Injures Rider

An unidentified motorcyclist sustained serious injuries when he lost control of his motorcycle and went down a road near Aguanga in Riverside County,approximately 88 miles from San Diego. This motorcycle accident occurred on Sage Road on September 6, 2010, around 2:30 p.m. According to California Highway Patrol officers, the motorcyclist apparently lost control and skidded off the right shoulder of the road.

Car Runs Into San Bernardino Home


A 71-year old woman and her 43-year old son suffered serious injuries when a Nissan Titan veered into their home on September 14, 2010, around 1:40 a.m. According to California Highway Patrol officers, the pickup truck crashed through the bedroom and living room of the victim’s home in Victorville, located approximately 100 miles from San Diego in San Bernardino County.

Fortunately, six to seven people sleeping upstairs escaped unhurt. The pickup truck driver, though, suffered minor injuries in this truck accident. The Fire Department crew that responded to the accident scene shored up the house to prevent it from collapsing. Hopefully it will not be “red-tagged” as uninhabitable and torn down.

Lompoc Rollover Car Accident Injures Driver

A single vehicle rollover accident on September 14, 2010, in Santa Barbara County left one person seriously injured. Pedestrian Struck on I-5 Ramp To Coronado Bridge

The victim sustained serious injuries and was transported to a nearby hospital for treatment. The driver of the car stopped at the accident scene until the police reached the scene and did not flee. San Diego Police are investigating the cause of this accident and why the car struck the pedestrian.

California law holds that drivers must give the right of way to pedestrians in marked crosswalks and at an intersection whether the crosswalk is marked or not. However, even if the pedestrian is in the roadway, a driver must still avoid a collision with the pedestrian who is more vulnerable to injury. From the present facts, it seems that the car driver violated the right of way when he struck the pedestrian. A 31-year old woman along with her 11-year old daughter, and her 3-month old daughter, Ruby Gould, were struck by a car while trying to cross a marked crosswalk in Huntington Beach. This fatal pedestrian accident occurred on September 7, 2010, at the intersection of Croupier Drive and Springdale Street, approximately 91 miles from San Diego in Orange County.


According to Huntington Beach Police, a Toyota Tundra that stopped to let the pedestrians cross the street was rear ended by a speeding Chevy Tahoe that failed to stop at the intersection.

The force of the traffic collision pushed the Tundra into the crosswalk, striking the three pedestrians Unfortunately, Ruby was killed, while the mother and young girl sustained severe injuries. The boy who was walking along with the group escaped unhurt. The investigation of this car accident is pending.

Based on the present facts, the Chevy Tahoe driver will probably be found at fault for failing to stop at the intersection and provide the right of the way to the pedestrians as required by California Vehicle Code Section 21950. This California law holds that drivers must give the right of way to pedestrians in marked crosswalks and at an intersection. Violation of this law may entitle the injured woman for compensation to cover the cost of funeral arrangements for Ruby, cost of hospitalization and treatment of injuries, and other related damages.

We express our sincere condolences to all those who knew and loved the toddler for such a tragic loss. There is nothing as tragic as the loss of a child. It is just too painful to imagine. We also sincerely hope and pray that the injured victims are able to recover to their complete health soon.

Woman Rescued from San Diego Rollover Auto Accident

An unidentified woman was rescued from her overturned car around 11:10 a.m. on August 28, 2010, and was immediately rushed to a nearby hospital with injuries. According to the San Diego Fire and Rescue Department, the exact reason of how the woman’s vehicle flipped near the intersection of 54th Street and Chollas Parkway in Chollas Creek was unclear.

San Diego Fire and Rescue Department officer said that traffic was blocked from the intersection where police were conducting an investigation to determine why the vehicle rolled over.

If the car overturned due to any mechanical failure or an unkempt road, then the automobile manufacturer or the authorities responsible for maintenance of the road might be held liable to pay a compensation for the injured victim’s medical costs and pain and suffering damages. Newhall Toddler Seriously Injured In Dog Attack

A 5 year-old toddler, Jose Sadino, was seriously injured in a dog attack at a Newhall apartment complex on June 11, 2010. According to the news stories, a vicious pit bull jumped out of a window and started attacking Jose who was playing with other children outside the apartment complex. Sadino’s mother, along with a few neighbors, intervened and made the dog go away. Los Angeles Sheriff’s officers took the pit bull into custody to determine if it had a prior bite history and whether the owner will face any criminal charges.

Jose Sadino sustained serious injuries, but thankfully none of them are expected to be life threatening. The owner of the pit bull may be held liable for the injuries caused and may have to compensate for the expenses involved. Clearly, the owner should have made sure that the pit bull was securely tied and that it was restrained. Dog owners have an absolute duty to make sure that their animals do not injure or kill others. Further, in a civil justice context, dog owners can be held strictly liable for any damage or injury caused by their dog.

We sympathize with Jose Sadino’s family and wish him a complete recovery soon. We hope that his wounds heal and that his scars, if any, can be treated and minimized. Jose Sadino’s parents can seek compensation for their medical expenses and suffering from the pet owner if this accident occurred due to his/her negligence. Driver Under the Influence Collides with San Diego Firefighter Truck

Yesenia Mitre, 25, collided with a firefighters’ truck and left four firefighters injured. The truck was on its’ way to answer a medical emergency on the morning of June 13, 2010. According to reports, Mitre drove out directly in the lane of traffic the fire truck was travelling in close to Alpine in eastern San Diego County. Due to the collision, the fire truck lost control and hit a pole.

According to the San Diego 6 news report, Mitre was driving under the influence and was arrested. The four firefighters sustained serious injuries while Mitre sustained a broken wrist.

It is indeed an unfortunate thing that due to the negligent and intoxicated driver, the four firefighters were badly injured. It is absolutely insane that instead of giving way to the emergency truck, Mitre drove right into its path. Mitre will most likely be found to have violated California Vehicle Code Section 23152(a) which states that “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” Under California law, it is also illegal to drive a vehicle with a blood alcohol content of 0.08 percent or higher.

Florida Woman Killed in Santa Barbara Pedestrian Accident

Garcia Flores, 47-years old of Florida, was killed in a Santa Barbara pedestrian accident at Coast Village Road on May 27, 2010. Flores was walking across an intersection when she was hit by a mini-van.

The mini-van was driven by a 17 -year old driver who lost control of his van and struck Flores badly, throwing her more than a few feet away towards the intersection of Coast Village and Butterfly Lane, where she died immediately. The teenager told Police Officers that his van suddenly started to veer to the right, and when he tried hitting the brakes, they didn't work. He says that is when the van jumped the curb and hit Flores. Officials found drug paraphernalia and marijuana in the teen’s minivan, but it is not certain that he was under influence of any drug or alcohol.

We offer our condolences to Flores’s family and friends for such an irreparable and tragic loss. If the teenager is found to be under the influence of drugs, we hope that he is prosecuted as an adult to the fullest extent of the law. Regardless, if the accident was caused by the teenage driver, we hope that Flores’s family consults with a personal injury attorney and obtains key advice as to how to balance the scales of justice in this case. They will never be made whole—Flores is dead and cannot be brought back—but the civil justice system can at least help minimize some of the loss.

Women Injured In San Clemente Hit & Run Accident

A woman was injured in a tragic Orange County pedestrian accident on May 14, 2010, at El Camino Real and Avenida Pico at San Clemente, when she was struck by a car while she crossing the street. Officials reported that the car driver, who was believed to be under the influence of alcohol, hit her and fled from the scene.

The victim was immediately taken to a local hospital where she received medical treatment for her injuries. Police have described the hit and run vehicle as a Saab, but no one has been taken into custody as yet.

We hope that the driver is caught and brought to justice. There are few things worse than a person who causes a serious injury and flees the scene of the accident without helping the person they injured. Before the accident, the driver was facing a driving under the influence criminal charge. Now, after leaving the scene, the driver is now about to be charged with felony drunk driving and hit-and-run with injury. California Vehicle Code 20001(a) requires those responsible for causing an accident to remain at the scene until authorities arrive, to exchange insurance and contact information, and to assist the injury victim.

San Diego Bus Accident Injures Nine People

Nine people were injured in a San Diego bus accident that occurred between a Metropolitan Transit System and a Mitsubishi Eclipse in the City Heights area of San Diego on March 24, 2010 around 3:40 p.m.

The car driver was apparently drunk and ran a red light at the University Avenue intersection with 37th Street. He then collided into the bus that was eastbound on the 37th Street. The car rammed into the bus just behind its front wheels which made the Eclipse spin. The drunk driver fled from the scene on foot. The collision caused back and neck pains to nine of the forty passengers.

Our office hopes for the young driver of the Eclipse is caught as soon as possible and prosecuted. He should be charged for such reckless behavior and for felony drunk driving causing injury. Driving while intoxicated is inexcusable, particularly when it causes serious injury.
