Elderly Pedestrian Injured In San Diego Car Accident

An unidentified 71-year-old pedestrian was struck by a car twice on November 20, 2010, in the Normal Heights area of San Diego around 7:15 a.m. According to San Diego Police Sgt. Ray Battrick, the elderly pedestrian was walking on the sidewalk in the 4100 block of 33rd Street when a car backing out of a driveway hit him.

The car driver, after hitting the pedestrian, thought he hit a trash can, so he pulled the car forward and then again hit the pedestrian. The elderly pedestrian suffered injuries to his hip, legs, and ankle in this serious pedestrian accident.

The elderly pedestrian was immediately transported to a nearby hospital for treatment. The 30-year-old car driver was later cited for not possessing a valid driving license.

From the present facts, it is pretty evident that car driver’s negligence and inattentive driving lead to this major pedestrian accident that injured the elderly man. It is surprising that he did not notice a man and thought he hit a trash can! Since he did not possess a driving license, it would be interesting to know if he was even qualified or trained to drive a car. Further, it would be interesting to determine if he was driving under the influence of alcohol or any other drug. Certainly the car driver could be held liable for the pain and suffering that the pedestrian went through as well at the cost of medical treatment, hospitalization charges, lost wages, and other accident related damages.

The elderly pedestrian would be well served by consulting with an experienced San Diego pedestrian accident lawyer who would be able to advise as to his rights and make sure that he receives the compensation that he deserves.

We sincerely hope and pray that the elderly man did not sustain any life threatening injuries and that his injuries heal soon.
